sprites overlapping each other

I've got this problem:
I made a top down 2d rpg engine.
i've got diff. sprites with verious Y-axis values, because the sprites are drawn on the screen in order of the according character connected with the sprite, they should only overlap the other sprite if the Y-value is higher then the sprite under it. Can anyone help me with this?

Well, it is called Z-Order. What I do is having an array with the sprites. The sprites will be drawn following the array, and that array is sorted in each frame according to the sprites "y" position.
